These Terms of Service (“Terms”) govern your access to and use of the Critical Post website at critical-post.com and the services we provide. By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.

Critical Post is a Sydney-based post-production management and delivery business serving the film and television industry. In these Terms, “Critical Post”, “we”, “us” and “our” refer to Critical Post, and “you” refers to the person or organisation using our website or services.

04Intellectual property

All content on this website — including text, graphics, logos, images, the Critical Post and Cine Sound names and branding, and any software — is owned by Critical Post or its licensors and is protected by Australian and international intellectual property laws. You may not use, reproduce or distribute any of it without our prior written permission, except as permitted by law.

05Client & talent obligations

Crew and talent registered with Critical Post agree to provide accurate and up-to-date information about their skills, experience, credits, rates and availability. Clients engaging our services agree to provide accurate role descriptions, timelines, deliverable requirements and commercial details. In our placement services, Critical Post acts as an intermediary and is not a party to the employment or engagement agreement between a client and any crew or talent.

06Confidentiality

We recognise the sensitive, pre-release nature of the film and media content we handle. Project details, talent information and placement arrangements are treated as strictly confidential. Where you receive confidential information from us, you agree to keep it confidential and use it only for the agreed purpose.

07Music licensing

Music licensed through Critical Post is subject to the specific licence terms agreed at the time of engagement, including any usage, territory and term restrictions. Those licence terms set out what you may and may not do with the music. Critical Post warrants that it has the right to license the music it provides through its service.

08Fees & payment

Fees for our services are as set out in the applicable quote, statement of work or licence agreement. Unless stated otherwise, fees are exclusive of GST and any other applicable taxes, which will be added where required. Payment terms are as specified in the relevant agreement or invoice.

09Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our services come with guarantees that cannot be excluded, and to the extent permitted by law, our liability for breach of such a guarantee is limited to re-supplying the services or paying the cost of having them re-supplied.

10Limitation of liability

To the maximum extent permitted by law, Critical Post is not liable for any indirect, incidental, special, consequential or punitive loss or damage arising from your use of our website or services. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the specific services giving rise to the claim. We do not guarantee any particular placement outcome or the suitability of any crew or talent for a particular role.

Our website may link to or rely on third-party sites and services. We are not responsible for the content, availability or practices of those third parties, and your use of them is subject to their own terms.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
